During the first visit to our Brooklyn location, the new client will hire the law firm of Reibman & Weiner to work for them.  Hiring a lawyer or law firm is referred to as a retainer or retaining the firm.  We are retained when the new client signs a standard retainer agreement naming the law firm of Reibman & Weiner as their lawyers. 
In personal injury lawsuits, the lawyer or law firm usually works on a contingency fee, as we do in all personal injury cases.  That typically means the lawyer works without any payment by the client and only collects a fee if there is a successful outcome and collection of money on behalf of the injured client.  In New York State, the fee for a contingency fee lawsuit is one-third (33 1/3%) of the amount recovered, after the case expenses are deducted.  In New York, the contingency fee for a medical malpractice case is less than one-third.  The amount of the fee is listed on a special retainer agreement used in medical malpractice cases and the amount of the fee actually goes down as more money is recovered.
In order to have a successful personal injury lawsuit it is necessary to spend money to prosecute the case.  Personal injury lawyers pay those expenses as the case progresses and expect to be reimbursed at the conclusion of a successful case.  For example, there are Court fees that are paid to start a lawsuit.  Expert testimony may be necessary to prove parts of the case and expert witnesses charge for their time in reviewing the materials, writing reports and coming to court to testify.  All personal injury lawsuits will have an injured person who was treated at a hospital or by private doctors.  The personal injury law firm must obtain all medical and treatment records and the medical providers charge fees to supply those records.  There are other costs in bringing a lawsuit and even the most basic type of accident case may cost about $2,000.00 in expenses paid by the personal injury law firm as the case progresses.  It is the practice of Reibman & Weiner to pay those costs without any contribution from the client, so that a personal injury client of Reibman & Weiner will not have to pay any money at all to have their case brought into court and litigated until there is a final determination.  Once a case is settled and money collected, the amount of money spent by Reibman & Weiner is first deducted from the total settlement and then the one-third fee is calculated from the remaining amount.
